Can someone file a kratom lawsuit?

A person who experienced a serious injury after using an identifiable kratom or concentrated 7-OH product may be able to pursue a product-liability or related claim. Eligibility depends on the product, warnings, medical causation, timing, seller or manufacturer, jurisdiction, and filing deadline. A diagnosis by itself does not establish liability.

Who may qualify for a claim review?

A review may be appropriate when kratom or a concentrated kratom-related product was followed by hospitalization, liver injury, seizure, respiratory depression, cardiac injury, diagnosed substance use disorder, permanent injury, or death. Claims require evidence connecting a product and responsible party to the alleged harm.

Which injuries are being reviewed?

What legal issues may be investigated?

Depending on state law and the facts, counsel may investigate whether a product was defectively designed or manufactured, whether warnings or instructions were adequate, whether marketing statements were misleading, and whether a seller or other entity breached a legal duty. These are fact-specific questions, not conclusions about every kratom product or company.

What evidence should be preserved?

  • Original containers, labels, lot numbers, remaining product, and photographs.
  • Receipts, order confirmations, bank records, retailer details, and shipping records.
  • Emergency, hospital, laboratory, toxicology, treatment, and pharmacy records.
  • A factual timeline of use, symptoms, treatment, and communications.
  • Advertisements, webpages, social posts, or representations that influenced the purchase.

See the complete product-preservation checklist. Do not alter, consume, test, or discard remaining product.

Is there a kratom class action or nationwide settlement?

There is no single nationwide compensation program for every person who used kratom. Claims can involve different products, injuries, companies, states, and courts. A lawyer must evaluate your individual circumstances rather than relying on an advertised settlement amount. See the latest court and regulatory developments.

What compensation may be available?

Depending on the evidence and applicable law, compensation may include medical expenses, lost income, pain and suffering, or wrongful-death damages. Each claim is different. A prior verdict or judgment does not establish what another person may recover.

How long do I have to file?

Deadlines differ by state, claim, age, injury date, discovery date, and defendant. Some notice requirements can be shorter than a statute of limitations. Requesting a review does not pause any deadline.

What happens after a submission?

  1. The intake team reviews the basic product, injury, treatment, and timing information.
  2. Additional records or product evidence may be requested.
  3. A lawyer determines whether further investigation or representation may be appropriate.

Submitting information does not create an attorney-client relationship. Representation begins only after conflicts review and a written engagement agreement signed by the lawyer and client.
